These Terms and Conditions form a legally binding contract between you and The Safe Centre.
Every quotation, pro-forma invoice, price list or other similar document made or issued by The Safe Centre ("the company") is made or issued subject to these General Terms and Conditions of Sale. These terms and conditions do not affect consumers' statutory rights as contained in current legislation governing the relationship between consumers and businesses.
The Company means The Safe Centre. The Customer or you, means the account applicant or person who buys or agrees to buy goods from the company.
Acceptance of Orders
No order resulting from any quotation, pro-forma invoice, price list or other similar document made or issued by the company shall be binding unless and until it is accepted by the company. The company at its absolute discretion may accept or reject any order whether on account of the equipment being no longer available or for any other reason whatsoever.
The company warrants that the goods will be at the time of delivery correspond to the description given by the company. It is the responsibility of the customer to check the compatibility and suitability of goods for any particular purpose before ordering. The company hereby reserves the right to make without notice such minor modifications in specifications, designs or materials as it may deem necessary or desirable by experience.
Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and the company shall not be liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer.
Damages and Shortages
The customer shall report any damage or shortage to the company and the carriers in writing within 7 days of delivery. Provided prompt notice of transit damage or loss is given the company will repair such equipment free of charge to the customer. Minor abrasions to the safe are to be expected if installation is carried out and this is not considered as damage.
Payment should be made prior to delivery.
Ownership and Risk
The risk in the goods shall pass from the company to the customer upon delivery of such goods to the customer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the customer until the company has received in cash or cleared funds, payment in full for all goods delivered to the customer under this and all other contracts between the company and the customer for which payment of the full price of the goods there under has not been paid. All new safes are guaranteed for one year on all working parts subject to servicing by a The Safe Centre Technician or any of our recommended or appointed technicians; other service agreements can be negotiated by contacting us. Repairs should be arranged and will be carried out during the hours of nine to five, Monday to Friday only.
Should any equipment malfunction as a result of misuse or tampering (including without prejudice attempted repairs by a non The Safe Centre technician, attempts to move the safe and all types of excessive pressure applied to the lock mechanism or handle) then all costs incurred by the company in repairing such equipment and investigating the causes of the malfunction shall be payable to the company.
Under no circumstances shall the company be responsible for any indirect, incidental or consequential damages.
Safes and cabinets with fixing holes in the base and/or rear are designed specifically for wall and/or floor (bolt down) installation.
Your insurer may insist on a security safe being installed to meet the manufacturer's recommended cash rating.
We recommend all safe installations are carried out by a qualified installer. Our teams are fully trained, safe installation professionals.
All reconditioned safes are refurbished and re-sprayed. Shelving can be provided, where it is not already existing with the safe at the customers request at an additional minimal fee.
New safes of grade 1, 2 and 3 come with a key lock as standard. Manual combinations and digital locks are available on request and are fitted for an additional charge. It is recommended and is often an insurance requirement that all safes under 1000 kg are anchored to the floor. This requires drilling into the floor and therefore customers must be aware of the proximity of pipes, wires or under-floor heating at the safes location. All fixing is undertaken at the customers’ risk.
Refurbished safes can in many instances also be adapted to combination or electronic lock at additional cost.
Fixing of safes and floor loadings
Fixing of safes involves drilling into floor. The customer will be responsible for any consequential damage that may occur if we drill into any services.
The customer shall be responsible for ensuring that the floor that the safe is positioned on, or is transported over, is structurally adequate to support the weight of the safe.
Parking tickets and congestion charging
If the customer insists on a delivery on a day when no other deliveries are being made within the London Congestion Charge zone then The Safe Centre reserves the right to pass this charge on to the customer.
If the customer cannot guarantee parking and there are parking restrictions at the delivery site that The Safe Centre have not been informed of prior to delivery, then The Safe Centre reserves the right to pass on any fines or charges to the customer.
Waiting time is charged after 30 minutes of waiting if the cause of the delay in the commencement of works is no fault of The Safe Centre. Rates of waiting time will depend on the time of day, i.e. whether over time charges are applicable, which vehicle type is being used and the number of staff involved. If a job is cancelled with less than 72 hours notice (standard office working hours) or cannot be completed for no fault of The Safe Centre, The Safe Centre reserve the right to charge for the cancelled works up to 100% of their value.
All prices given will include Vat @ 20%.
